Terms of Service

These terms apply to all commissions taken and are subject to change.Upon agreeing to commission me, the artist, you, the client, are acknowledging that you have read and are agreeing to these terms.This document was last updated on August 2, 2023.


Transactions

Payments

Payment is due immediately up front, no matter if it is partial or full. If the client cannot pay in full immediately, and only present a partial pay, then that will serve as a deposit. No work will be started until I have received the full amount that is due.Currently, I only accept Paypal and Venmo (USD).

Refunds

Refunds are only permitted in the following cases:

  • Work has not begun on the piece, or has not progressed past the sketch phase.

  • The commission is believed to have been lost in the mail for longer than thirty (30) days. A 50% refund will be issued.

  • I have chosen not to proceed with the commission.

  • The client is showing innappropriate behavior towards me during the commission process. A 50% refund will immediately be issued, and the client will be blacklisted.

All cases will be handled at my discretion, but a refund may not always be guaranteed.

Payment Plans

Payment plans are accepted. I am more than happy to work with you to build a timeline.If the client is unable to be reached after 60 days have passed - or any other agreed upon timeline - since their last message or payment, I have the right to keep all funds sent to me. This does not apply if the client has communicated that they are currently unable to send a payment, and maintains active communication - this is key. A weekly message will be sent starting from the approximate date the next payment will have been due until either a reply is received, or the time period has ended.


Rights

Artist Rights

I have the right to refuse accepting a commission if I feel uncomfortable for any reason.I MUST be credited if the client chooses to repost their piece in public. The only exception to this is if the commission is for commercial use and this was discussed prior. If the commissioned piece is a gift to someone else, then that person may repost the piece, provided they own the rights to the character being depicted.I may use any piece(s) I create for self promotion, examples for a portfolio, etc., and therefore may also repost said piece(s) into public galleries or online markets to be an example of what I can create.Because I am creating your piece(s), I hold rights to distribute as I see fit. However, I will NEVER sell your commission as my own merchandise - it is rightfully yours.Absolutely none of my artwork is to be minted into an NFT under any circumstances, by anyone.

Client Rights

Only the client is permitted to repost their commissioned piece. The client may edit their piece, reprint it, etc., so long as credits for the original piece are still made to me. If it is a digital piece, my signature must not be removed (except when cropping to use as an avatar, as that cannot be helped).The client is permitted to make merchandise of their piece under the condition that the intention is NOT to sell under their own business, unless it was previously discussed during the commission process.


Commission Process

General Info

I primarily work in a traditional format - that means paper, pencils, pens, colored pencils, and markers. Please keep this in mind when commissioning me.I require a name, a reference sheet of the character, and a general idea of what you want done (if you have one). I will default to Artistic Freedom if you don't have any preference to how you want your commission to be depicted.

Sketches

Sketches will be sent to the client AT LEAST two times - the first depicting the general idea, and the second being the refined and potentially final sketch. The client is strongly encouraged and must inform me of any changes needing to be made during this stage, as the piece going forward will be permanent and cannot be changed very easily when working in a traditional format.Requesting a refund on a piece that has been sketched, but has not had any further work done to it, will result in the client's forfeiture to the rights to the piece, and I have the right to repurpose the sketch for another commission.

Edits/Changes

Any changes submitted by the client after the sketch has been approved by the client will not be guaranteed to be applied. There will be a 24 hour waiting period after the last change has been brought to my attention to give the client time to think about any other suggestions or reconsiderations to be made. If I feel the changes are getting to be excessive, a small fee may be applied. The commission will not proceed until that fee is paid, as I deserve to be paid for the time and effort I am putting into the commission.

Mailing

Once the piece has been placed in the mail, I am not responsible for any delays in shipping, how the package is handled while in transit, the condition of the package upon arrival, or if the package becomes lost. If the client believes the package is lost, and it has been thirty (30) days since the package was confirmed to be mailed, the client is entitled to a 50% refund, or another piece, free of charge.Concerning badges: All will be laminated and holepunched before being shipped out to you. All packaging will have a cardboard slip to help protect the piece while in transit.

Deadlines

If there is a deadline to which the commission must be completed, please notify me AT LEAST 2 months, or sixty (60) days, in advance to account for shipping or unforeseeable delays.

Other Important Info

I have a job (Rover) outside of art, as well as a family - husband, toddler, and three pets - to take care of. Those are my first priority, and always will be. I will do my best to communicate any delays, but please understand that I am not in a constant state of working on art.I am a human being, and I deserve to also take time to myself to enjoy other hobbies I'm interested in. I have a life outside of the computer.


Blacklisting

Anyone is subject to being blacklisted at my discretion. A 50% refund will immediately be issued if a client has already paid. If a commission has already been started, it will be repurposed.Unacceptable behaviors include, but are not limited to:

  • Flirting, sexual advances (sexting, inappropriate pictures, etc.)

  • Harassment

  • Stalking

  • Discrimination

  • Threats

  • Pestering (example: asking if a commission is done within a short time period after it was submitted/constantly asking for updates within a short time period)

Blacklisted Clients

None so far. Yay!


F. A. Q.


Q: What do you typically work with?
A: Pentel QE515 mechanical pencil for sketching, Micron pens and Faber-Castell pens for lining, and Copic markers and Prismacolor colored pencils for coloring. I also use Gelly Roll gel pens for highlights.

Q: What does your turnaround time look like?
A: That can vary, depending on the size of the piece I'm working on. Smaller pieces should take no longer than 2-3 weeks, but larger pieces can take upwards of a couple of months or so. It really depends on how much time I have to be able to sit down at the end of the day to work on them.
